Acceptance of Terms
The Jodi Murphy Grooming Trivia Contest (herein
"Contest") is solely part of
PetGroomer.com owned, operated and provided by Find A Groomer, Inc.
to you free of charge, "as is," and subject to all applicable laws
and regulations and the following Official Rules, which may be
updated by Find A Groomer, Inc. from time to time without notice to
you. You can review the most current version of the Official Rules
at any time by coming to this web page. By accessing PetGroomer.com
and participating in its games and promotions, you accept, without
limitation or qualification, these Official Rules. In addition, when
accessing this contest page, you shall be subject to any posted
guidelines or rules applicable to such services which may be posted
from time to time. All such guidelines or rules are hereby
incorporated by reference into these Official Rules.
Automatic Disqualification Warning Notice for Entries
Find A Groomer, Inc. will comprise the entirety of Contest judges to
conduct the drawing of the winner's name.
Winner will be announced on this Contest page and the GroomerTALK
Community forum at PetGroomer.com.
Contests are provided "as is" without express or implied warranties
of any kind, including but not limited to, the implied warranties of
merchantability, fitness for a particular purpose, or
non-infringement. While the Contest used its best efforts to include
accurate and up to date information Find A Groomer, Inc. makes no
warranties or representations as to its accuracy. Find A Groomer,
Inc. assumes no liability or responsibility for any errors or
omissions in the content of the Contests. Find A Groomer, Inc.
assumes no responsibility for the timeliness, deletion, misdelivery
or failure to store any user communication or personalization
settings.
The Contest is subject to all applicable laws in any state or
other jurisdiction. Participation in the games and promotions is
void in every jurisdiction in which participation is prohibited by
any law, statute, regulation or other appropriate authority. Find A
Groomer, Inc. does not warrant that participation in the games and
promotions at the Contest is permitted in any jurisdiction.
Find A Groomer, Inc. may, in its sole discretion and at any time,
modify or discontinue the Contest; limit, terminate or suspend your
use of or access to the Contest; and/or make changes to these
Official Rules or the game specific official rules.
Participation
By participating in the Contest, you accept and agree to be
bound by these Official Rules, the decision of the game judges which
shall be final and binding in all respects, and by individual games
and promotion official rules and regulations. Further, by
participating in the Contest you agree to be bound by the
PetGroomer.com Mission Statement, Disclaimer Notice and Privacy
published at
www.petgroomer.com/mission.htm.
Find A Groomer Inc cannot certify, nor accept any
responsibility, that your computer is enabled to play our JAVA based
trivia contest. JAVA for PC's and MAC's is available at
www.java.com.
Eligibility
Contest may be played by U.S. Citizens and residents
of Canada except Quebec. Limit one prize per entrant. You may only
enter the Contest one time.
No purchase or fee is required to play or win the
Contest. Contest is open to persons eighteen (18) years of age or
older unless noted otherwise at the time they enter the contest.
The eligibility to receive prizes after winning any prize in the
Contests are subject to all of the provisions contained in these
Official Rules, without limitation. Should Find
A Groomer, Inc. determine, in its sole discretion, that any
PetGroomer.com visitor or entrant has violated any of the
prohibitions contained in the Official Rules, Find A Groomer, Inc.
shall have no obligation to award any prizes won by violators. Find A Groomer, Inc. assumes no responsibility for lost, late or
misdirected mail, email or electronic communication. Incomplete,
illegible, or mutilated communications, will be disqualified.
Contest is not open to the owners and management of any
PetGroomer.com banner advertising sponsor, or their advertising
agency, or the staff of Find A Groomer Inc., or the owner,
management and staff of JodiMurphy.net. Registration and Privacy Issues All official entries to win prizes become the exclusive property of
Find A Groomer, Inc., owner/operator/provider of PetGroomer.com.
Find A Groomer, Inc., may at its discretion continue to publish all
entries without limitation. No limit to the duration of the display
of entries shall be affected upon Find A
Groomer, Inc. By entering the Contest(s), you agree and accept that Find A Groomer,
Inc. may be required to file certain information with various
governmental agencies with respect to prizes exceeding certain
amounts, and, in such event, an entrant that wins any such prize
must complete any written materials that may be required by any such
governmental agencies and will be requested to do so by Find A
Groomer, Inc. Failure of an entrant to comply with Find A Groomer,
Inc.'s request will result in the winners forfeiture of such prize.
Winners are solely responsible for all Federal, state, local or
other applicable taxes with respect to the prizes awarded by the

www.petgroomer.com/mission.htm. Prizes and Prize Winners Winner of
the Contest will receive a timely notification
congratulating him/her on winning in writing, usually within 30 days of the
winners being announced. In most cases, the notification is in the
form of an e-mail prompt notifying the entrant of his or her win,
and a prize claim form by regular postal mail. Subject to the
provisions of this paragraph and where appropriate, winnings are
mailed by postal mail or courier WITHIN THIRTY (30) DAYS AFTER
CONFIRMATION OF A VALID WIN CLAIM. In order to receive prizes,
winning entrants must be eligible as described in these Official
Rules. E-MAIL NOTIFICATIONS DO NOT CONSTITUTE A GUARANTEE OF PAYMENT
OF ANY KIND. Find A Groomer, Inc. RESERVES THE RIGHT TO VERIFY THE
ELIGIBILITY OF ALL WINNERS PRIOR TO MAKING ANY PAYMENT TO THEM OF
ANY KIND. Find A Groomer, Inc. ALSO RESERVES THE RIGHT TO REFUSE
PAYMENT TO ANY PERSONS WHO ARE NOT ELIGIBLE AS DESCRIBED IN THESE
OFFICIAL RULES. For the name of the Prize Winner of the Contest
in writing, send your written request in a letter along with a
self-addressed, stamped envelope to: Find A Groomer, Inc.

Yelm, WA 98597 Residents of WA and VT may omit return postage on self-addressed
envelopes. Allow 4 to 6 weeks for delivery of any requested winners
list. Taxes, if any, are the sole responsibility of the prize
winners. Winner providing only a PO Box on their entry or prize claim may be required
to provide an alternate address for delivery of prize. When applicable, all taxes, meals, entertainment, tips,
transportation, and all other items not specified herein or in the
game specific official rules are the responsibility of the winner.
The prize or prizes cannot be exchanged for cash and cannot be used
in conjunction with any other promotion. All prizes are subject to
availability. No substitution or transfer of prize permitted. Winner will be notified by e-mail and receive a first class postal
mail confirmation. Game winner may be required to submit valid
identification to Find A Groomer, Inc. and to execute an Affidavit
of Eligibility and Publicity and Liability Release Form within

(30) business days of first notification. Failure to comply within
this time period may result in disqualification and awarding of the
prize or winnings to another eligible entrants. Limitations of Liability and Release All federal, state and local laws and regulations apply. Find A
Groomer, Inc. is not responsible for any incorrect or inaccurate
registrations or games play information or entry of information.
Find A Groomer, Inc./PetGroomer.com assumes no responsibility for
any error, omission, interruption, deletion, defect, delay in
operation or transmission, communications line failure, theft or
destruction or authorized access to, or alteration of, Find A
Groomer, Inc./PetGroomer.com is not responsible for any problems,
errors or technical malfunction of any telephone network or lines,
computer on-line-systems, servers or providers, computer equipment,
or software, or any failure of email on account of technical
problems or traffic congestion on the Internet or at any Website or
combination thereof, including injury or damage to participants or
to any other person’s computer related to or resulting from
participating at the Contest. If, for any reason, the Contest is not
capable of running as planned, including infection by computer
virus, bugs, tampering, unauthorized intervention, fraud, technical
failures, or any other causes beyond the control of Find A Groomer,
Inc./PetGroomer.com which corrupt the administration, security,
fairness, integrity or proper conduct of Find A Groomer, Inc. reserves the right at its sole discretion to
cancel, terminate, modify or suspend the Contest. Find A Groomer,
Inc./PetGroomer.com is not responsible for late, lost, illegible,
incomplete, stolen, misdirected, damaged or postage due
communications. ANY ATTEMPT BY A PETGROOMER.COM VISITOR OR ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY
WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF the Contest IS A
VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE
MADE, Find A Groomer, Inc./PetGroomer.com RESERVES THE RIGHT TO SEEK
DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY
LAW. Any communication that is illegible, incomplete, late will be
disqualified. Find A Groomer, Inc. reserves the right to halt the
play of a game or games at any time and for any duration of time due
to situations beyond its control such as strikes, acts of God, etc.
Find A Groomer, Inc. reserves the exclusive right, exercisable in
its sole discretion, to (i) add additional games, along with such
games' official rules, to the Contest at any time, or (ii)
discontinue the Contest game at any time without notice. Find A
Groomer, Inc. further reserves the exclusive right, exercisable at
any time, without notice, to amend, add to, delete from, alter or
otherwise change the Official Rules, or the games specific official
rules, in such manner as Find A Groomer, Inc., in its sole
discretion, shall determine appropriate for playing the Contest and
operating the Contest on the Internet. All decisions made with
respect to the Contests, these Official Rules and the games specific
official rules are the sole responsibility of Find A Groomer, Inc.
The Contest may not be used for any form of gambling. The Contest is
void where prohibited by law. All PetGroomer.com site visitors may participate in the Contest, at
any time, but only eligible entrants according to these Official
Rules may be awarded the prize resulting from playing the Contest.
PetGroomer.com visitors and entrants release Find
A Groomer, Inc. its employees, officers, directors, banner
advertisers, representatives
and agents, and its successors and assigns from all liability from
any and all losses, damages, rights, claims, and actions of any kind
including, without limitation, personal injuries, death, and
property damage, and claims based on publicity rights, defamation,
or invasion of privacy, either directly or indirectly related to or
arising from the use or misuse of the Contest or from acceptance,
possession, misuse, or use of any prize. Each PetGroomer.com visitor
and entrant further acknowledges that such
parties have neither made nor are in any manner responsible or
liable for any warranty, representation or guarantee expressed or
implied, in fact or in law, relative to the games and promotions on
the Contest or any prize, including but not limited to its quality
or fitness for a particular purpose. They agree to be bound by these
Official Rules and the games specific official rules. They consent
to the use of their names and likenesses for advertising and
promotional purposes without additional compensation, unless
prohibited by law. Find A Groomer, Inc. and its agents are not
responsible for technical, hardware or software failures of any
kind, lost or unavailable network connections, or failed,
incomplete, garbled or delayed computer transmissions which may
limit their ability to participate in the Contests web site
activities and games. Find A Groomer, Inc., by law, may be required
to withhold certain taxes or other assessments with respect to the
prizes awarded on the Contest and reserves the right to withhold any
such applicable taxes with respect to such prizes. Disclaimer Regarding Advertisers, Sponsors and Linked Content Find A Groomer, Inc. may provide, or third parties may provide,
links to other sites or resources located on the World Wide Web.
Find A Groomer, Inc. has no control over such sites and resources.
You acknowledge and agree that Find A Groomer, Inc. is not
responsible for the availability of such external sites or
resources, and does not endorse and is not responsible or liable for
any content, advertising, products, or other materials on or
available from such sites or resources. You further acknowledge and
agree that Find A Groomer, Inc. shall not be responsible or liable,
directly or indirectly, for any damage or loss caused or alleged to
be caused by or in connection with use of or reliance on any such
content, goods or services available on or through any such site or
resource. Your correspondence or business dealings with, or participation in
promotions of, advertisers found on or through the Contest,
including payment and delivery of related goods or services, and any
other terms, conditions, warranties or representations associated
with such dealings, are solely between you and such advertiser. You
agree that Find A Groomer, Inc. shall not be responsible or liable
for any loss or damage of any sort incurred as the result of any
such dealings or as the result of the presence of such advertisers

sites containing information that some people may find inappropriate

concerning any effort to review the content of any of the sites

publication. Find A Groomer, Inc. shall not be held responsible for
the accuracy, copyright or trademark compliance, legality, or

materials of their respective owner and/or Find A Groomer, Inc. and
its other content providers and partners. Reproduction or storage of
materials retrieved from this service is subject to the U.S.
Copyright Act of 1976, Title 17 U.S.C. The trademarks and service marks displayed on the Contest,
including, but not limited to, the names of all games, contests,
photographs, and promotions are registered and unregistered
trademarks and service marks of Find A Groomer, Inc., advertising
sponsor(s) or photograph owners. Use of any trademark or service
mark displayed at the Contest or PetGroomer.com in general without
the express written consent of their registered owner of the
trademark or service mark is strictly prohibited. Relationship of Parties You acknowledge and agree that you and Find A Groomer, Inc. are
independent contractors under these Official Rules, and nothing
herein shall be construed to create a partnership, joint venture,
agency, or employment relationship. Neither party pursuant to these
Official Rules has authority to enter into agreements of any kind on
behalf of the other and neither party shall be considered the agent
of the other. Merger These Official Rules constitute the entire agreement between the
parties with respect to the subject matter contained herein and
supersedes any other agreement, proposals and communications,
written or oral, between Find A Groomer, Inc. representations and
you with respect to the subject matter hereof. Intellectual Property Infringement Claims It is the policy of the Find A Groomer, Inc./PetGroomer.com to
respond expeditiously to claims of intellectual property
infringement. Find A Groomer, Inc. will promptly process and
investigate notices of alleged infringement and will take
appropriate actions under the Digital Millennium Copyright Act ("DMCA")
and other applicable intellectual property laws. Upon receipt of
notices complying or substantially complying with the DMCA, Find A
Groomer, Inc. will act expeditiously to remove or disable access to
any material claimed to be infringing or claimed to be the subject
of infringing activity and will act expeditiously to remove or
disable access to any reference or link to material or activity that
is claimed to be infringing. Find A Groomer, Inc. will terminate
access for subscribers and account holders who are repeat infringers
wherever possible, and advertising at PetGroomer.com where the
repeat infringer is a sponsor of PetGroomer.com. Notices of claimed

counter notifications submitted by the user will be furnished to the

material as a result of any counter notification. Arbitration, Governing Law and Forum for Disputes Unless expressly stated to the contrary all legal issues arising

determined by, the laws of the State of Washington applicable to

Any controversy or claim arising out of or relating to these
Official Rules or any user's use of the Contest shall be settled by
binding arbitration in accordance with the commercial arbitration
rules of the American Arbitration Association. Any such controversy
or claim shall be arbitrated on an individual basis, and shall not
be consolidated in any arbitration with any claim or controversy of
any other party. The arbitration shall be conducted in the State of
Washington, and judgment on the arbitration award may be entered
into in any state or federal court in Washington having jurisdiction
thereof. Any party seeking temporary or preliminary injunctive
relief may do so in any state or federal court in Washington having
jurisdiction thereof. Except as set forth above, the state and
federal courts of Washington shall be the exclusive forum and venue
to resolve disputes arising out of or relating to these Official
Rules and person(s) playing the Contest. By using the Products and
Services and thereby agreeing to these Terms and Conditions, users
consent to personal jurisdiction and venue in the state and federal
courts in Washington with respect to all such disputes. Violations of Official Rules Should you violate these Official Rules or any other rights of Find
A Groomer, Inc./PetGroomer.com, Find A Groomer, Inc./PetGroomer.com
reserves the right to pursue any and all legal and equitable
remedies against you.
