Only after being named a winner, and as part of the prize verification process, does each winner name 1 pet welfare organization to receive a cash prize paid on their behalf by Find A Groomer Inc., the owner of PetGroomer.com. Find A Groomer Inc. requires all payments to pet welfare organizations to be made payable to the organization directly, and to arrange for its delivery directly from the Find A Groomer Inc. offices. The organization is expected to be a recognized pet welfare organization, most likely a registered non-profit organization. In rare cases, Find A Groomer Inc. reserves the right to refuse a selected donor candidate when upon review by the management of Find A Groomer Inc. deems the named pet welfare organization reasonably inappropriate. If another qualified organization is not named, Find A Groomer Inc. will select a qualified non-profit pet welfare organization for the winner. All groomer and pet charity prizes are guaranteed to be paid out. EMAIL: Digital photographs may be submitted as email attachments to findagroomer@earthlink.net (and include your 100 to 250 word essay in the email along with your complete contact info). Incomplete entries may be disqualified. POSTAL: Print photographs not scanned may be submitted by postal mail to Find A Groomer Inc., PO Box 2489, Yelm, WA 98597, (and include your 100 to 250 word essay in the email along with your complete contact info). You may also submit digital photos on a floppy disk by postal mail if you don't wish to use email. Incomplete entries may be disqualified. Contest operates March 1, 2007 to December 31, 2007. Winners to be announced by 3/1/08. Awards made in June 2008. GROOMER: For each entry you submit, you must be the groomer who groomed the pet. HOLD HARMLESS: By entering the contest you warrant to Find A Groomer, Inc. that you are the lawful owner of the photographs. Further, if you do not own the pet displayed in the photographs, you warrant to Find A Groomer, Inc. that you have the express permission of the pet owner of the pet in the submitted photos to enter the photos in this contest. By submitting photographs to Find A Groomer, Inc. as entry into the Contest you hold harmless Find A Groomer, Inc. and its advertising sponsors from any claims that may arise from the actual owners of the photos and/or pet making a claim that they are the lawful owner of the photographs or pet displayed in them. Wrap photographs in protective packaging to prevent folding or heat damage. Your name and contact info should be written on the back of each photo submitted by postal mail. Acceptance of Terms Welcome to Miracle Pet Makeover: PetGroomer.com Photo Contest, part of PetGroomer.com owned, operated and provided by Find A Groomer, Inc. to you free of charge, "as is," and subject to all applicable laws and regulations and the following Official Rules, which may be updated by Find A Groomer, Inc. from time to time without notice to you. You can review the most current version of the Official Rules at any time by coming to this web page. By accessing PetGroomer.com and participating in its games and promotions, you accept, without limitation or qualification, these Official Rules. In addition, when accessing Miracle Pet Makeover: PetGroomer.com Photo Contest, you shall be subject to any posted guidelines or rules applicable to such services which may be posted from time to time. All such guidelines or rules are hereby incorporated by reference into these Official Rules. Automatic Disqualification Warning Notice for Entries All pets must be groomed by a human person, and the person entering the photos must be the actual groomer of the pet in the photos entered, no exceptions. Retouching of "before" photos by hand or computer software to replace having to groom the pet thereby creating "after" photos is an automatic disqualification. In addition, anyone personally grooming a pet(s) and entering the pet(s) as groomed by any other person other than them self is an automatic disqualification. Also, anyone having their pet groomed by another person other than them self, and entering their photos representing that they are the groomer of the pet in the photos entered is an automatic disqualification. As part of the winner verification process potential winners will be asked to sign a statement that they have not violated these guidelines, and others as noted here. Description of Miracle Pet Makeover: PetGroomer.com Photo Contest Miracle Pet Makeover: PetGroomer.com Photo Contest (hereafter "Contest") may be supported by one or more advertisers. It may be massively multiplayer. It is located on the World Wide Web at the PetGroomer.com web site at http://www.petgroomer.com. There is not contest entry fee, and it is open to all eligible players. Cash prizes are awarded for winning sets of photographs; and prizes are awarded in U.S. dollars. The Contest duration is 12:01 am PST, March 1, 2007 to 12:01 am PST, December 31, 2007. Additional Entry Information You may scan and submit your photos in JPG, GIF, BMP or TIF format. JPG seems to work best for most people though. You can send your files on a standard PC 3.5 inch floppy disk to the above address, or by e-mail to findagroomer@earthlink.net as MIME attachments. Photographs or digital files entered in the Contest must be of reasonable quality to be reproduced and published on the Internet at PetGroomer.com. At the discretion of Find A Groomer, Inc. photos or scans judged of poor quality will not be eligible for cash prizes or published at PetGroomer.com. No photographs will be returned. Do not send your original or only photographs or digital files. Find A Groomer, Inc. is not responsible for entries lost or damaged in transit to its offices by any means. Winners agree that their photos may be published in promotional materials such as advertisements and press releases related to the contest in all media, such as trade magazines, newsletters. Your name, mailing address and telephone contact information should be printed on the back of photos mailed to Find A Groomer, Inc. offices, or on the label of any floppy disks submitted. Find A Groomer, Inc. agrees that all entrants retain their copyright to the photographs they submit, and that all submissions published will have a copyright notice labeled under the photographs with the owner's name, and "all rights reserved." Photographs posted on the Internet are never safe from copying. Do not enter your photos if you cannot accept that Internet users may copy your photograph files without our permission. By submitting your photographs for publishing at PetGroomer.com you agree to hold harmless Find A Groomer, Inc. from any and all claims arising from Internet users copying pictures without the permission of Find A Groomer, Inc. Winning photos will be chosen for their conformance to these contest rules, their general photographic quality, and for visually communicating the essence of a remarkable grooming transformation from a pet in poor grooming condition to a well-groomed condition. Also, the winning photos are expected to visually communicate that a well-groomed pet is happy to now be in well-groomed condition. Find A Groomer, Inc. and selected associates will comprise the entirety of Contest judges. The contest closes December 31, 2007. Thereafter, a period of 21 days will be allowed for postal mail Registrant entries to arrive at Find A Groomer, Inc. All postal mail delivery official entries must be postmarked no later than January 15, 2008. Please use first-class or air mail for your entry sent by postal mail. On March 1, 2008 the winners will be announced on the Home Page of PetGroomer.com at www.petgroomer.com. All winners are subject to verification including their eligibility based on these Official Rules. The Contest is provided "as is" without express or implied warranties of any kind, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. While the Contest uses its best efforts to include accurate and up to date information Find A Groomer, Inc. makes no warranties or representations as to its accuracy. Find A Groomer, Inc. assumes no liability or responsibility for any errors or omissions in the content of the Contest. Find A Groomer, Inc. assumes no responsibility for the timeliness, deletion, misdelivery or failure to store any user communication or personalization settings. The Contest is subject to all applicable laws in any state or other jurisdiction. Eligibility The Contest may be played by visitors of any country, but only U.S. residents and Canadian residents, except those of Quebec, are eligible to win prizes. Limit one prize per Registrant. No purchase or fee is required to play or win the Contest. The Contest is open to persons eighteen (18) years of age or older unless noted otherwise. Residents from the Province of Quebec, Canada, are not permitted to win prizes in the Contest. Winners not eligible for cash prizes will be sent gifts from Find A Groomer Inc. The prize funds allocated to a pet welfare association in their winning categories will be donated by Find A Groomer Inc. to one of its pet welfare associations it supports. The eligibility to receive prizes after winning any prize in the Contest is subject to all of the provisions contained in these Official Rules, without limitation. Employees, officers, directors, agents, representatives, and their immediate family (defined as parents, spouse, children, siblings, and grandparents) and household members, of Find A Groomer, Inc. (collectively referred to herein with its affiliates and subsidiaries as "(PetGroomer.com") and its affiliates, subsidiaries, PetGroomer.com advertising and promotion agencies are NOT eligible to win prizes in the Contest. Should Find A Groomer, Inc. determine, in its sole discretion, that any PetGroomer.com visitor or entrant has violated any of the prohibitions contained in the Official Rules, Find A Groomer, Inc. shall have no obligation to award any prizes won by violators. Find A Groomer, Inc. assumes no responsibility for lost, late or misdirected mail, email or electronic communication. Incomplete, illegible, or mutilated communications, will be disqualified. Registration and Privacy Issues All official entries to win prizes become the exclusive property of Find A Groomer, Inc., owner/operator/provider of PetGroomer.com. Find A Groomer, Inc., may at its discretion continue to publish all entries without limitation. No limit to the duration of the display of entries in these photo galleries shall be affected upon Find A Groomer, Inc. Find A Groomer, Inc. reserves the right to use and reuse all registration information in accordance with Find A Groomer, Inc. Privacy Policy. However, Registrants may edit, update, alter or obscure their Registrations or elements of their Registrations without limitation, at any time and as often as desired by e-mail to findagroomer@earthlink.net or by postal mail to: Find A Groomer, Inc. By entering the Contest, you agree and accept that Find A Groomer, Inc. may be required to file certain information with various governmental agencies with respect to prizes exceeding certain amounts, and, in such event, a Registrant that wins any such prize must complete any written materials that may be required by any such governmental agencies and will be requested to do so by Find A Groomer, Inc. Failure of a Registrant to comply with Find A Groomer, Inc.'s request will result in the winners forfeiture of such prize. Winners are solely responsible for all Federal, state, local or other applicable taxes with respect to the prizes awarded by the Contest. Prizes and Prize Winners All prizes are cash in U.S. dollars which will be paid by money order or cashiers check, or grooming industry products and/or services valued at manufacturers suggested retail value in U.S. dollars. Winners of the Contest will receive a timely notification congratulating him/her on winning, usually within 30 days of the winners being announced. In most cases, the notification is in the form of an e-mail prompt notifying the Registrant of his or her win, and a prize claim form by regular postal mail. Subject to the provisions of this paragraph and where appropriate, winnings are mailed by postal mail or courier WITHIN THIRTY (30) DAYS AFTER CONFIRMATION OF A VALID WIN CLAIM. In order to receive prizes, winning Registrants must be eligible as described in these Official Rules. E-MAIL NOTIFICATIONS DO NOT CONSTITUTE A GUARANTEE OF PAYMENT OF ANY KIND. Find A Groomer, Inc. RESERVES THE RIGHT TO VERIFY THE ELIGIBILITY OF ALL WINNERS PRIOR TO MAKING ANY PAYMENT TO THEM OF ANY KIND. Find A Groomer, Inc. Allow 4 to 6 weeks for delivery of any requested winners list. Taxes, if any, are the sole responsibility of the prize winners. Residents of Canada will be responsible for any goods and service taxes. Members who provide with their entry only a P.O. Box may be required to provide an alternate address for delivery of prizes. When applicable, all taxes, meals, entertainment, tips, transportation, and all other items not specified herein or in the game specific official rules are the responsibility of the winner. The prize or prizes cannot be exchanged for cash and cannot be used in conjunction with any other promotion. All prizes are subject to availability. No substitution or transfer of prize permitted. Winners will be notified by e-mail and receive a first class postal mail confirmation. All game winners may be required to submit valid identification to Find A Groomer, Inc. and to execute an Affidavit of Eligibility and Publicity and Liability Release Form within five (5) business days of first notification. Failure to comply within this time period may result in disqualification and awarding of the prize or winnings to another eligible Registrant. If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Find A Groomer, Inc./PetGroomer.com which corrupt the administration, security, fairness, integrity or proper conduct of Find A Groomer, Inc. The Madson Group Inc. reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest. Find A Groomer, Inc./PetGroomer.com is not responsible for late, lost, illegible, incomplete, stolen, misdirected, damaged or postage due communications. ANY ATTEMPT BY A PETGROOMER.COM VISITOR OR REGISTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF the Contest IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, Find A Groomer, Inc./PetGroomer.com RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. Neither party pursuant to these Official Rules has authority to enter into agreements of any kind on behalf of the other and neither party shall be considered the agent of the other. Merger These Official Rules constitute the entire agreement between the parties with respect to the subject matter contained herein and supersedes any other agreement, proposals and communications, written or oral, between Find A Groomer, Inc. representations and you with respect to the subject matter hereof. Intellectual Property Infringement Claims It is the policy of the Find A Groomer, Inc./PetGroomer.com to respond expeditiously to claims of intellectual property infringement. Find A Groomer, Inc. will promptly process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws. Upon receipt of notices complying or substantially complying with the DMCA, Find A Groomer, Inc. will act expeditiously to remove or disable access to any material claimed to be infringing or claimed to be the subject of infringing activity and will act expeditiously to remove or disable access to any reference or link to material or activity that is claimed to be infringing. Find A Groomer, Inc. will terminate access for subscribers and account holders who are repeat infringers wherever possible, and advertising at PetGroomer.com where the repeat infringer is a sponsor of PetGroomer.com. Notices of claimed infringement should be directed to: Find A Groomer, Inc. Please put "Notice of Infringement" in the subject line of all such notifications.
